TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the Education Destination Malaysia website, mobile applications, chatbot services, events, content and related services (collectively, the "Platform").

The Platform is owned and operated by Mint Media Sdn Bhd (Registration No: 201901001611 (1310937-T)) ("Mint Media", "we", "us" or "our").

By accessing or using the Platform, you agree to be legally bound by these Terms.

1. DEFINITIONS

In these Terms:

"Advertiser" means any educational institution, exhibitor, sponsor, service provider or other party advertising or promoting products or services through the Platform.

"AI Services" means any artificial intelligence, machine learning, generative AI, conversational chatbot, recommendation engine, automated assistant or similar technology made available through the Platform.

"AI Services Notice" means Schedule 1 to these Terms, as amended from time to time.

"Content" means all text, images, videos, graphics, audio, software, databases, information, articles, educational materials, documents and other materials made available through the Platform.

"Educational Information Disclaimer" means Schedule 2 to these Terms, as amended from time to time.

"Personal Data" shall have the meaning assigned under the Personal Data Protection Act 2010 and any amendments thereto.

"Platform" means the Education Destination Malaysia website, chatbot, mobile applications, online services, educational fairs, events and related services operated by Mint Media.

"User", "you" or "your" means any individual or entity accessing or using the Platform.

2. ACCEPTANCE OF TERMS

2.1 By accessing, browsing, registering for, or using the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms.

2.2 If you do not agree to these Terms, you must immediately cease using the Platform.

2.3 If you use the Platform on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

2.4 Mint Media reserves the right to amend these Terms from time to time. Updated Terms shall become effective upon publication on the Platform unless otherwise stated.

2.5 Continued use of the Platform after publication of amended Terms constitutes acceptance of the amended Terms.

2.6 The AI Services Notice and Educational Information Disclaimer form part of and are incorporated into these Terms by reference. By using the Platform, Users agree to be bound by the provisions contained in the AI Services Notice and Educational Information Disclaimer.

3. ELIGIBILITY

3.1 You must be at least fifteen (15) years old to create an account or submit information through the Platform.

3.2 If you are under eighteen (18) years old, you confirm that you have obtained the consent of a parent, guardian or person having parental responsibility.

3.3 Mint Media may refuse registration or access to any person at its sole discretion.

4. USER ACCOUNTS

4.1 Certain services may require registration.

4.2 You agree that all information provided by you shall be accurate, complete and up-to-date.

4.3 You are solely responsible for maintaining the confidentiality of your login credentials.

4.4 You are responsible for all activities conducted through your account.

4.5 You must immediately notify Mint Media of any unauthorised access or security incident affecting your account.

4.6 Mint Media reserves the right to suspend, restrict or terminate accounts where misuse, fraud, security risks or breaches of these Terms are suspected.

5. INTELLECTUAL PROPERTY

5.1 All intellectual property rights in the Platform and its Content belong to Mint Media or its licensors unless otherwise stated.

5.2 Nothing in these Terms transfers ownership of any intellectual property rights to any User.

5.3 Users are granted a limited, revocable, non-exclusive and non-transferable licence to access and use the Platform for lawful personal purposes.

5.4 Users shall not:

(a) reproduce, distribute, modify or commercially exploit any Content;

(b) reverse engineer any software forming part of the Platform;

(d) create derivative works based upon Platform Content; or

(e) use Platform Content for commercial purposes without prior written consent.

5.5 All rights not expressly granted are reserved.

6. ACCEPTABLE USE

6.1 Users shall use the Platform only for lawful purposes.

6.2 Users shall not:

(a) upload unlawful, defamatory, misleading, fraudulent or offensive material;

(b) infringe intellectual property rights;

(d) interfere with Platform security;

(e) attempt unauthorised access to systems or accounts;

(f) scrape, harvest or systematically extract data from the Platform;

(g) impersonate another person;

(h) submit false, misleading or inaccurate information;

(i) engage in conduct that may damage Mint Media's reputation; or

(j) use the Platform in breach of any applicable law.

6.3 Mint Media reserves the right to investigate suspected violations and take appropriate action, including suspension, termination and reporting to authorities.

7. USER CONTENT

7.1 Users may submit enquiries, comments, reviews, messages and other content.

7.2 Users warrant that they possess all necessary rights in respect of any content submitted.

7.3 By submitting content, users grant Mint Media a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, store, transmit and process such content for the operation and improvement of the Platform.

7.4 Users remain solely responsible for content submitted by them.

7.5 Mint Media reserves the right, but is not obliged, to remove any content at its discretion.

8. EDUCATIONAL INFORMATION

8.1 The Platform is intended as a source of general educational information.

8.2 Educational information available through the Platform may originate from educational institutions, advertisers, exhibitors, third parties or AI Services.

8.3 Mint Media does not verify every item of information published on the Platform.

8.4 Educational institutions may change admission requirements, tuition fees, scholarships, accreditation status, rankings, courses, programme structures and policies without notice.

8.5 Users must independently verify all information directly with the relevant institution or authority before making any educational, financial, immigration, career or personal decision.

8.6 Nothing on the Platform constitutes educational consultancy advice, legal advice, immigration advice, financial advice or professional advice.

8.7 Users acknowledge and agree that educational information made available through the Platform is further subject to the Educational Information Disclaimer set out in Schedule 2.

9. AI SERVICES AND CHATBOT

9.1 The Platform may provide AI Services, including conversational chatbot functionality powered by third-party artificial intelligence technologies. The AI Services are intended solely to assist Users by providing general educational information and do not make decisions on behalf of Users or determine legal rights, eligibility or other matters having legal or similarly significant effects. Users acknowledge that such AI Services are supplementary informational tools only and are subject to the AI Services Notice in Schedule 1.

9.2 AI-generated responses are produced using automated processing technologies. The AI Services are designed to assist Users by generating informational responses and are not intended to make decisions on behalf of Users or to produce decisions that have legal or similarly significant effects on Users.

9.3 Users acknowledge and agree that AI-generated outputs:

(a) may contain inaccuracies;

(b) may contain omissions;

(d) may be outdated;

(e) may contain errors;

(f) may be misleading; and

(g) should not be relied upon without independent verification.

9.3A Users acknowledge that the AI Services assist Users in locating and understanding educational information only. Any educational pathway, admission, scholarship, visa or related decision remains the responsibility of the User and the relevant educational institution or governmental authority.

9.4 AI-generated outputs are provided solely for general informational purposes.

9.5 AI-generated outputs do not constitute legal advice, educational advice, immigration advice, financial advice, professional advice or recommendations.

9.6 Users remain solely responsible for evaluating, verifying and relying upon any information generated by AI Services.

9.7 Mint Media makes no representation, warranty or guarantee regarding the accuracy, completeness, reliability, suitability or timeliness of AI-generated outputs.

9.8 Users shall not submit confidential information, sensitive personal data, passwords, financial information or information belonging to third parties into AI Services unless authorised to do so.

9.9 Users shall not use AI Services:

(a) to generate unlawful content;

(b) to generate harmful, defamatory or discriminatory content;

(d) to reverse engineer the AI Services;

(e) to benchmark or train competing artificial intelligence systems; or

(f) for any unlawful purpose.

9.10 Mint Media reserves the right to modify, restrict, suspend or discontinue AI Services at any time without notice.

9.11 Use of the AI Services is further subject to the AI Services Notice set out in Schedule 1, which forms part of these Terms.

10. ADVERTISERS AND THIRD-PARTY CONTENT

10.1 Advertisers are solely responsible for the accuracy and legality of information submitted by them.

10.2 Mint Media does not endorse, guarantee or warrant any products, services, courses, scholarships or representations made by Advertisers.

10.3 Mint Media is not a party to any agreement entered into between a User and an Advertiser.

10.4 Users interact with Advertisers entirely at their own risk.

10.5 The Platform may contain links to third-party websites.

10.6 Mint Media is not responsible for the content, security, privacy practices or availability of third-party websites.

11. EVENTS AND EDUCATIONAL FAIRS

11.1 Mint Media may organise educational fairs, webinars, conferences, seminars and related events.

11.2 Event programmes, speakers, exhibitors and schedules may change without notice.

11.3 Attendance at events is at the participant's own risk.

11.4 Mint Media reserves the right to refuse entry, remove attendees or cancel events where necessary.

11.5 Photographs, videos and recordings may be taken at events for promotional, reporting, archival and operational purposes.

11.6 By attending events, participants consent to such recording and use, subject to applicable data protection laws.

12. FEES AND PAYMENTS

12.1 Certain services provided by Mint Media may be subject to fees.

12.2 Users agree to pay all applicable fees in accordance with the relevant invoice, quotation, booking form, service agreement or event registration terms.

12.3 Unless otherwise stated, all fees are exclusive of applicable taxes, duties and governmental charges.

12.4 Full payment shall be due within the period specified by Mint Media.

12.5 Mint Media reserves the right to suspend services where payment remains outstanding.

12.6 Interest may be charged on overdue sums at the rate specified in the applicable invoice or agreement, or where no rate is specified, at eight per cent (8%) per annum calculated on a daily basis.

12.7 Except where required by law or expressly agreed by Mint Media in writing, all payments made are non-refundable.

13. PRIVACY AND PERSONAL DATA

13.1 Mint Media processes Personal Data in accordance with its Privacy Notice and applicable data protection laws.

13.2 By using the Platform, you acknowledge that your Personal Data may be collected, used, disclosed, transferred, stored and otherwise processed for the purposes described in the Privacy Notice.

13.3 Users acknowledge that information submitted through enquiries, event registrations, scholarship applications, educational fairs, webinars, surveys and other Platform features may be disclosed to relevant educational institutions, exhibitors, sponsors, service providers or other parties where necessary to fulfil the purpose of the request.

13.4 The Platform may utilise cookies, analytics tools, tracking technologies and similar technologies. Further details are set out in the Cookie Notice.

13.5 Where AI Services are utilised, information submitted by Users may be processed by Mint Media and authorised technology providers for the purpose of generating responses, quality assurance, security monitoring, troubleshooting and service improvement.

13.6 Users should not submit confidential information, sensitive personal data or information belonging to third parties unless necessary and authorised.

13.7 Mint Media may transfer Personal Data to service providers located outside Malaysia where necessary for the operation of the Platform, subject to applicable legal requirements and appropriate safeguards.

13.8 Nothing in these Terms limits any rights or obligations arising under applicable data protection legislation.

14. DISCLAIMERS

14.1 The Platform, Content, AI Services and all related services are provided on an "as is" and "as available" basis.

14.2 To the fullest extent permitted by law, Mint Media expressly disclaims all warranties, representations and guarantees, whether express, implied, statutory or otherwise.

14.3 Mint Media does not warrant that:

(a) the Platform will be uninterrupted;

(b) the Platform will be error-free;

(d) the Platform will always be secure;

(e) the Platform will always be available; or

(f) the Platform will be free from viruses or harmful components.

14.4 Mint Media does not guarantee the accuracy, completeness, reliability, legality, suitability, quality or timeliness of:

(a) educational information;

(b) scholarship information;

(d) admission requirements;

(e) visa information;

(f) advertiser content;

(g) user-generated content; or

(h) AI-generated outputs.

14.5 Educational institutions, advertisers and third parties are solely responsible for the information supplied by them.

14.6 Users acknowledge that AI Services may generate inaccurate, incomplete, misleading or outdated information.

14.7 Users must independently verify all information generated by AI Services before relying upon it.

14.8 No information provided through the Platform shall constitute:

(a) legal advice;

(b) immigration advice;

(d) financial advice;

(e) tax advice;

(f) professional advice; or

(g) recommendations upon which reliance should be placed without independent verification.

14.9 Users use the Platform entirely at their own risk.

14.10 Without limiting any provision of these Terms, the disclaimers, acknowledgements and limitations contained in Schedule 1 and Schedule 2 shall apply to all use of the Platform.

15. LIMITATION OF LIABILITY

15.1 To the fullest extent permitted by law, Mint Media shall not be liable for any indirect, incidental, consequential, exemplary, special or punitive damages.

15.2 Mint Media shall not be liable for:

(a) loss of profits;

(b) loss of revenue;

(d) loss of business;

(e) loss of goodwill;

(f) loss of data;

(g) loss of anticipated savings; or

(h) business interruption.

15.3 Mint Media shall not be liable for any losses arising from:

(a) reliance upon educational information;

(b) reliance upon scholarship information;

(d) decisions made by educational institutions;

(e) admission decisions;

(f) scholarship decisions;

(g) visa decisions;

(h) third-party conduct;

(i) advertiser content; or

(j) unauthorised access to user accounts.

15.4 Mint Media shall not be responsible for any decision made by a User based upon information generated by AI Services.

15.5 Users acknowledge that AI-generated outputs may contain inaccuracies, omissions, errors or outdated information.

15.6 Without prejudice to the foregoing, Mint Media's total aggregate liability arising out of or relating to the Platform shall not exceed:

(a) where the User has paid fees to Mint Media, the total fees paid by that User to Mint Media during the twelve (12) months preceding the event giving rise to the claim; or

(b) where the User has not paid any fees to Mint Media, Ringgit Malaysia One Hundred (RM100.00).

15.7 Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.

15.8 The User acknowledges that the allocation of risk reflected in these Terms, including Schedule 1 and Schedule 2, forms an essential basis of the agreement between Mint and the User.

16. INDEMNITY

16.1 Users agree to indemnify, defend and hold harmless Mint Media, its related corporations, directors, officers, employees, agents and service providers from and against all claims, demands, actions, proceedings, losses, damages, liabilities, costs and expenses (including legal fees on a solicitor-client basis) arising from or relating to:

(a) the User's breach of these Terms;

(b) misuse of the Platform;

(d) infringement of intellectual property rights;

(e) content submitted by the User;

(f) reliance by third parties upon information supplied by the User; or

(g) use of AI Services in breach of these Terms.

16.2 Mint Media reserves the right to assume the exclusive conduct of any defence or settlement of any matter subject to indemnification.

17. SUSPENSION AND TERMINATION

17.1 Mint Media may suspend, restrict or terminate access to the Platform immediately and without notice where:

(a) a User breaches these Terms;

(b) security concerns arise;

(d) unlawful activity is suspected;

(e) payment obligations remain outstanding; or

(f) Mint Media reasonably believes suspension is necessary to protect its interests, Users or the public.

17.2 Users may cease using the Platform at any time.

17.3 Suspension or termination shall not affect accrued rights, obligations or liabilities.

17.4 Clauses relating to intellectual property, disclaimers, limitation of liability, indemnity, privacy, governing law and dispute resolution shall survive termination.

18. CYBERSECURITY AND PLATFORM SECURITY

18.1 Users shall not:

(a) attempt to gain unauthorised access to any system or network;

(b) test the vulnerability of the Platform without written authorisation;

(d) engage in denial-of-service attacks;

(e) upload malicious software;

(f) intercept communications;

(g) use automated tools to extract Platform data; or

(h) interfere with the operation of the Platform.

18.2 Mint Media reserves the right to monitor Platform usage for security, compliance and operational purposes.

18.3 Suspected security incidents may be reported to law enforcement authorities or relevant regulators.

19. FORCE MAJEURE

19.1 Mint Media shall not be liable for any delay, interruption or failure to perform resulting from events beyond its reasonable control, including:

(a) natural disasters;

(b) pandemics;

(d) telecommunications failures;

(e) power outages;

(f) governmental actions;

(g) labour disputes; or

(h) failures of third-party service providers.

20. GOVERNING LAW AND JURISDICTION

20.1 These Terms shall be governed by and construed in accordance with the laws of Malaysia.

20.2 The courts of Malaysia shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.

20.3 Prior to commencing legal proceedings, the parties shall use reasonable efforts to resolve disputes through good faith discussions.

21. CHANGES TO THE PLATFORM

21.1 Mint Media reserves the right to:

(a) modify the Platform;

(b) add or remove features;

(d) introduce new services;

(e) discontinue existing services; or

(f) suspend any functionality,

at any time and without prior notice.

21.2 Mint Media shall not be liable for any consequences arising from such modifications.

22. GENERAL PROVISIONS

22.1 These Terms constitute the entire agreement between Mint Media and the User concerning the Platform.

22.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22.3 A failure or delay by Mint Media in exercising any right shall not constitute a waiver of that right.

22.4 Users may not assign, transfer or otherwise dispose of their rights or obligations under these Terms without Mint Media's prior written consent.

22.5 Mint Media may assign or transfer its rights and obligations without restriction.

22.6 These Terms may be executed and accepted electronically.

22.7 Nothing in these Terms creates any partnership, joint venture, agency or employment relationship.

22.8 In the event of any inconsistency between these Terms and Schedule 1 or Schedule 2, the provisions of these Terms shall prevail to the extent of the inconsistency unless expressly stated otherwise.

23.2 Legal notices shall be sent to the above contact details unless otherwise notified by Mint Media.

23.3 Electronic communications shall satisfy any requirement for written notice where permitted by law.

SCHEDULE 1

AI SERVICES NOTICE

1. APPLICATION

This AI Services Notice applies to all users who access or use any artificial intelligence, machine learning, chatbot, virtual assistant, recommendation engine or other AI-powered functionality made available through the Education Destination Malaysia platform ("AI Services").

2. INFORMATIONAL PURPOSES ONLY

The AI Services are provided solely for general informational purposes.

AI-generated outputs do not constitute:

(a) legal advice;

(b) immigration advice;

(d) educational consultancy advice;

(e) academic advice;

(f) financial advice;

(g) tax advice; or

(h) professional advice of any kind.

Users should obtain independent advice from qualified professionals where appropriate.

2A. AUTOMATED PROCESSING

The AI Services utilise automated technologies to generate responses based on user prompts and available information.

The AI Services are not intended to:

(a) determine a User's legal rights;

(b) determine eligibility for admission;

(d) determine immigration status;

(e) make decisions that produce legal or similarly significant effects on Users.

3. NO GUARANTEE OF ACCURACY

Users acknowledge that AI-generated outputs may:

(a) contain inaccuracies;

(b) contain omissions;

(d) be outdated;

(e) contain errors;

(f) fail to reflect the latest institutional requirements, scholarship criteria, visa policies or regulatory requirements.

Mint Media Sdn Bhd ("Mint Media") does not warrant, represent or guarantee the accuracy, completeness, reliability, suitability or timeliness of any AI-generated output.

4. USER RESPONSIBILITY

Users are solely responsible for evaluating, verifying and relying upon information generated by the AI Services.

Before making any educational, academic, financial, immigration, career or personal decision, users must independently verify relevant information directly with the appropriate institution, authority or professional adviser.

5. USER INPUTS

Users should not submit:

(a) confidential information;

(b) sensitive personal data;

(d) banking information;

(e) medical information;

(f) information belonging to third parties unless authorised to do so.

6. AI SERVICE PROVIDERS

Mint Media may engage third-party AI service providers and technology partners to operate, support or improve AI Services.

User interactions may be processed by such providers in accordance with applicable contractual, security and privacy requirements.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mint Media shall not be liable for any loss, damage, costs, expenses, liabilities or claims arising directly or indirectly from:

(a) use of AI Services;

(b) reliance upon AI-generated outputs;

(d) interruption, suspension or unavailability of AI Services; or

(e) any decision made by a user based upon AI-generated information.

8. MODIFICATION OR DISCONTINUATION

Mint Media reserves the right to modify, suspend, restrict or discontinue any AI Services at any time without notice.

SCHEDULE 2

EDUCATIONAL INFORMATION DISCLAIMER

1. GENERAL DISCLAIMER

The Education Destination Malaysia platform provides educational information for general informational purposes only.

While Mint Media Sdn Bhd ("Mint Media") seeks to maintain accurate and current information, Mint Media does not guarantee the accuracy, completeness, reliability or currency of any information published on the platform.

2. EDUCATIONAL INSTITUTIONS

Information relating to educational institutions may be supplied by the institutions themselves or other third parties.

Mint Media does not independently verify all information provided by educational institutions, advertisers, sponsors or third parties.

3. ADMISSION REQUIREMENTS

Admission requirements may change at any time without notice.

Users must verify all admission requirements directly with the relevant educational institution before submitting applications or making decisions.

4. TUITION FEES AND COSTS

Tuition fees, accommodation costs, administrative charges and other expenses may change without notice.

Published figures should be treated as indicative only unless expressly confirmed by the relevant institution.

5. SCHOLARSHIPS

Scholarship availability, eligibility criteria, application deadlines, award values and conditions may change without notice.

Publication of scholarship information does not constitute a guarantee of eligibility or award.

6. ACCREDITATION AND RECOGNITION

Accreditation status, professional recognition, programme approvals and regulatory recognition may change from time to time.

Users should independently verify accreditation and recognition status with the relevant authorities and institutions.

7. VISA AND IMMIGRATION INFORMATION

Visa and immigration information may be subject to changes in laws, regulations, policies and governmental practices.

Users must verify all visa and immigration requirements directly with the relevant governmental authorities.

8. EMPLOYMENT OUTCOMES

Information regarding graduate outcomes, employability, career prospects, salaries or employment opportunities is provided for informational purposes only.

Mint Media does not guarantee any educational, employment or career outcome.

9. LEAGUE TABLES AND RANKINGS

University rankings, league tables, ratings and performance indicators are opinions or assessments published by third parties.

Such rankings should not be regarded as guarantees of quality, suitability or future performance.

10. USER RESPONSIBILITY

Users remain solely responsible for conducting their own due diligence and making their own educational, financial, immigration and career decisions.
